AI has already been a part of the legal toolkit for a few years now, aiding us in document review and legal research. Much of the work AI has been helping us with thus far is akin to having a summer associate or legal assistant.

While our AI overlords haven’t come for our lawyering jobs (yet), the advent of generative AI, which is capable of analyzing documents and even suggesting litigation strategies, has taken AI capabilities and, of course, complexities to a whole new level.

The legal industry has been “using” AI for many years, but generative AI is a relatively new addition to our technological arsenal. 

What does it mean to use AI in your practice? It means harnessing technology to enhance your capabilities, not replace them. It’s about being more efficient and effective while maintaining the highest ethical standards.

AI is a powerful tool, but it’s not infallible, and AI and legal ethics can often be at loggerheads.

“Legal ethics” aren’t the first things that large language models are taught (surprise!), so it’s up to you to ensure that the use of AI aligns with the ethical obligations of the legal profession.

This requires a proactive approach, staying informed about the latest developments, and continuously refining your practices.

Understanding the ABA Model Rules of Professional Conduct

The American Bar Association (ABA) Model Rules of Professional Conduct, adopted by the ABA House of Delegates in 1983, serve as a cornerstone for legal ethics across most jurisdictions in the United States. One of the cornerstones of legal ethics is the duty of confidentiality. Rule 1.6 of the ABA Model Rules addresses confidentiality of client information.
